DinkBay Academy provides a platform for community connections and for students to find independent pickleball coaches. Unless DinkBay expressly identifies a particular program as DinkBay-operated, coaches are independent third parties, not employees, agents, or partners of DinkBay. Students and coaches independently agree on instruction, pricing, meeting places, and scheduling.
DinkBay does not guarantee any coach's qualifications, safety practices, availability, or performance. Any "trusted" or "verified" label must accurately describe checks actually performed. DinkBay does not represent that courts are reserved or permit commercial instruction.
I understand that pickleball lessons, games, clinics, and associated activities involve inherent risks, including falls, collisions with people or equipment, overexertion, heat exposure, and serious bodily injury. I voluntarily choose to participate and accept the ordinary inherent risks of participation.
I agree to follow reasonable safety instructions, use appropriate equipment, and stop participating if I feel unsafe or unwell. I understand that I should inform my coach of any limitations relevant to safe participation.
To the extent permitted by California law, I agree to release DinkBay Academy and its applicable owners, officers, and representatives from claims arising from ordinary negligence in connection with my voluntary participation in third-party activities arranged through the platform. This provision does not waive claims that cannot lawfully be released, including claims involving gross negligence, recklessness, intentional misconduct, or non-waivable statutory rights.
I understand that any separate waiver or agreement required by my coach or court operator is independent of this DinkBay waiver. This draft does not itself release a coach from liability or replace the coach's own safety obligations.
Before a real booking is finalized, participants should be shown the current waiver version, given an opportunity to read it, and required to affirmatively sign. The production system should retain the waiver version, signature, timestamp, and booking identifier securely.
Legal review required: California counsel should review this language, platform operations, insurance, minors' participation, e-signature compliance, and the separate coach agreement before launch.
Coach agreements, student risk acknowledgments, insurance checks and incident reporting.
Parties: DinkBay's operating legal entity (to be identified) and the individual or business offering coaching ("Coach"). This is a proposed agreement for attorney review, not an executed contract.
DinkBay provides discovery, messaging, booking-request and community tools. Coach independently determines whether to accept requests, lesson methods, lawful rates, schedules and permitted venues. Nothing here by itself determines employment classification; applicable California law and actual working practices control.
Coach is responsible for their own instruction, supervision, equipment decisions, reasonable safety precautions, appropriate emergency response, legal compliance and obtaining permission for commercial coaching at selected facilities. Coach must not represent themselves as an employee or agent of DinkBay without written authorization.
Before activation, Coach must provide evidence of appropriate general and professional liability coverage with limits and endorsements specified in the final agreement. Where available and appropriate, Coach must arrange an additional-insured endorsement for DinkBay's legal entity. DinkBay may request updated proof, but review does not guarantee coverage.
Subject to California law and the final negotiated wording, Coach would defend and indemnify DinkBay against specified third-party claims arising from Coach's negligent or wrongful acts or breaches of this agreement, excluding responsibility that cannot legally be transferred. DinkBay remains responsible for its own non-waivable duties.
Coach must prioritize emergency services, then promptly notify DinkBay of serious incidents or safety complaints through a secure reporting process, cooperate with reasonable investigation, and preserve relevant records in accordance with law and privacy rules.
DinkBay may suspend or remove listings for documented safety concerns, suspected fraud, policy breaches, or expired insurance, subject to fair review and applicable law. Booking cancellation, payments, refunds, dispute handling, and termination must be defined in the final agreement.
Have counsel review worker classification, enforceability of indemnification, insurance, consumer protection, arbitration/dispute clauses, venue, and local recreational-facility rules before use.
Important: This is a sample outline, not an enforceable waiver. It must be reviewed by California counsel and adapted to the actual lesson provider, circumstances, and participant age.
Pickleball may involve falls, collisions, overexertion, impact from balls or paddles, weather and surface hazards, and serious injury. Students acknowledge these inherent risks and voluntarily choose whether to participate.
Students understand that listed third-party coaches ordinarily provide lessons independently from DinkBay. A student's coaching agreement and applicable coach-specific waiver may be separate from DinkBay's platform terms.
Students agree to follow reasonable safety instructions, use appropriate equipment, and stop participation when unsafe. Emergency assistance should be sought promptly when necessary.
Any release of ordinary-negligence claims must be clearly drafted and reviewed for enforceability under California law. No release may waive claims or duties that law prohibits waiving, including certain gross-negligence or intentional misconduct claims.
Do not use this adult demonstration waiver for minors. Parent/guardian consent, minor-specific rules, and California legal review are required before youth participation is supported.
Production signing should capture explicit consent, the complete displayed document, document version, identity and timestamp, with secure retention and an accessible copy for the signer.
A coach must be approved before appearing as verified. A certificate alone does not prove additional-insured status or that a particular activity is covered.
Status: No coach insurance has been verified by this prototype.
